"At the fairness hearing on May 18, 2011, the Court tentatively approved the terms of the settlement, but found there is additional information and testimony the Court needs to consider before it can determine the fairness of the settlement. THIS WILL DELAY PAYMENT TO ALL CLASS MEMBERS. We are very sorry for this, but it is beyond our control. Rest assured that we are doing everything that we can to move this along, and the Court is committed to moving this along as quickly as possible.
The Court has set deadlines for the additional work that needs to be completed. The Court has set a preliminary hearing for July 5, 2011. The final hearing/trial is scheduled for August 1-2, 2011. This means, under the terms of the settlement agreement, payments will likely not go out until August or September, assuming there are no further delays.
Again, we are truly sorry for this delay, and will continue to do everything in our power to move things along."
